DATES OF PROMOTION: The Promotion begins on August
31, 2020 and ends on September 4, 2020 (“Promotion Period”). There are
a total of five (5) separate promotions (each, a “Promotion” and
collectively, the “Promotions”), subject to the streaming dates and
times of each Promotion as outlined in the “PROMOTION PERIODS” section
below.
ELIGIBILITY: The Promotion is open only to persons
who are legal residents of one of the fifty (50) United States or the
District of Columbia and at least eighteen (18) years of age or older
or the age of majority in his/her state of residence at the time of
entry (each an “Entrant”). Employees and their immediate family
members (parents, children, siblings or spouse, regardless of where
they live, or persons living in same household, whether related or
not) of Intel Corporation (“Sponsor”) and each of its respective
parent companies, divisions, affiliates, subsidiaries, distributors,
advertising and promotion agencies, and any others engaged in the
development, production, execution or distribution of the Promotion,
including but not limited to National Sweepstakes Company, LLC (the
“Independent Administrator”), and the entities supplying the prizes
herein (all of the aforementioned collectively referred to as the
“Promotion Entities”), are not eligible to participate. Promotion is
subject to all federal, state, and local laws and regulations, without
regard to conflict of law provisions. Promotion is void outside of the
fifty (50) United States, the District of Columbia, and wherever else
restricted or prohibited by law. By entering the Promotion, the
Entrant indicates their full and unconditional agreement to and
acceptance of these Official Rules and the decision of the Sponsor,
which are final and binding in all respects. Winning is contingent
upon fulfilling all requirements set forth herein.
ENTRY PERIODS: There are a total of five (5)
Promotions each associated with a Twitch influencer. The five (5)
Twitch influencers are: (a) Holo, (b) Majin Taj, (c) Regis Killbin,
(d) CupAhNoodle, and (e) Femennenly. Each Promotion will run on the
dates and times listed in the chart below (each an “Entry Period), and
all entries must be submitted during this time to be included for that
Promotion’s drawing. All times are listed as Pacific Standard Time.
For each Promotion, one (1) grand prize winner (each a “Grand Prize
Winner”) will be selected. See “WINNING/ODDS” and “PRIZES” sections
for complete details.

HOW TO ENTER: Entrant will be required to log into
his or her Twitch account. Creating a Twitch account is free but is
subject to the applicable terms and conditions (https://www.twitch.tv/p/legal/terms-of-service/). Entrants may enter a Promotion by logging into his/her Twitch
account and visit
www.twitch.tv/omen
(the “Website”) during the Entry Period to watch the live stream and
comment into the chat with !giveaway to receive one (1) entry into the
respective Promotion. Entrant must include !giveaway to receive an
entry. Entrant must watch each live stream of each influencer
separately and comment in order to receive an entry for each of the
five (5) Promotions. Sponsor’s computer is the official time keeping
device for these Promotions.
There is a limit of one (1) entry per Entrant per Promotion. Entries
from previous Entry Periods will NOT carry over to subsequent Entry
Periods.
Any attempt by an Entrant to obtain more than one (1) entry by using
multiple/different, identities, email addresses, and/or any other
methods will void that Entrant’s entries and that Entrant may be
disqualified from the Promotion. Multiple Entrants are not permitted
to share the same Twitch account.
If a dispute regarding the identity of the person submitting an entry,
the entry will be disqualified. No mechanically or programmatically
reproduced entries are permitted. Sponsor will not verify receipt of
entries. All entries submitted become the sole property of Sponsor and
will not be returned. Sponsor is not responsible for lost, late, or
misdirected entries. Neither Sponsor, nor any other Promotion Entity,
are responsible for any entry that is lost, late, misdirected or
undeliverable, whether due to system errors, omissions, interruption,
deletions, defects, delay in operations or transmissions or any other
reason, theft or destruction or failures, faulty transmissions or
other telecommunications malfunctions, Entries not received resulting
from any hardware or software failures of any kind, lost or
unavailable network connections, failed, incomplete or garbled
computer or telephone transmissions, typographical or system errors
and failures, faulty transmissions, technical malfunctions, or
otherwise.
Without limitation, Sponsor reserves the right in their sole
discretion to disqualify any Entrant whose social media account, in
their sole opinion, refers, depicts or in any way reflects negatively
upon the Sponsor, the Promotion or any other person or entity; does
not comply with these Official Rules; or if Sponsor receives
notification about any potential infringements or breaches of law or
any other reason set forth herein.
DRAWING/ODDS OF WINNING: On or about the drawing date
outlined in the “ENTRY PERIODS” section above for each Promotion, a
representative of the Sponsor will randomly select one (1) Grand Prize
Winner from among all eligible entries received during the respective
Promotion Period. Odds of winning the grand prize (the “Grand Prize”)
are dependent upon the total number of eligible entries received
during the respective Entry Period. The random drawing will be
conducted by a representative of the Sponsor whose decision is based
upon his/her sole discretion and his/her interpretation of these
Official Rules, and is final and binding in all respects.
GRAND PRIZES: One (1) Grand Prize of an OMEN 15
laptop with two (2) OMEN accessories will be awarded to the Grand
Prize Winner. Total approximate retail value (“ARV”) of each Grand
Prize is a maximum of $1,409.97.
RESTRICTIONS: Grand Prize Winner agrees that the
Grand Prize is being provided “as is,” and the Promotion Entities make
no warranty, representation or guarantee regarding any prize,
including but not limited to its quality, condition, merchantability
or fitness for a particular purpose. No transfer, substitution, or
cash redemption of the Grand Prize is permitted, except at Sponsor’s
sole discretion or as otherwise provided herein. Sponsor reserves the
right to substitute a prize of equal or greater value if a prize or
element thereof becomes unavailable due to reasons beyond the control
of the Sponsor. Grand Prize Winner is solely responsible for any
federal, state, and local taxes if applicable. No more than the one
(1) Grand Prize per Promotion as set forth in these Official Rules
will be awarded. Promotion Entities are not responsible for any
changes of any element of the Grand Prize.
NOTIFICATION/GRAND PRIZE CLAIM: POTENTIAL GRAND PRIZE WINNER WILL BE
NOTIFIED WITHIN THREE (3) DAYS OF THE DRAWING DATE BY THE INFLUENCER
VIA ANNOUNCEMENT ON THE TWITCH STREAM AND ON THE INFLUENCER’S
TWITTER FEED (THE “NOTIFICATION”).
Grand Prize Winner must respond to the Notification as directed within
the date and time frame indicated. In the event that: (a) a potential
Grand Prize Winner fails to respond to the Notification the date and
time frame indicated; (b) a potential Grand Prize Winner fails to
supply the Required Documents (as defined in the “PRIZE CLAIMS”
section below); (c) any Notification is returned as undeliverable;
and/or (d) it is determined by the Sponsor, in their sole discretion,
that the potential Grand Prize Winner is not eligible in accordance
with these Official Rules, such potential Grand Prize Winner will be
disqualified and an alternate Grand Prize Winner will be selected in a
random drawing of the remaining non-winning eligible entries. Grand
Prize Winner consents to the use of his/her full name, likeness,
biographical information, videos, photos and voice in advertising
worldwide without additional compensation (TN residents will not be
required to sign a publicity release as a condition of winning a
prize). Influencer will make three (3) attempts per Promotion to award
the Grand Prize. If a Grand Prize Winner or the two (2) alternates do
not respond to the Notification, the Grand Prize will not be awarded.
Except where prohibited by law, in addition to supplying the
information as outlined in the "NOTIFICATIONS" section above, the
potential Grand Prize Winner will be required to complete and return
to the Sponsor representative, within five (5) days of receipt, an
affidavit of eligibility/release of liability/publicity release (the
"Release") and an IRS Form W-9 in order to claim his/her Grand Prize.
The Release and IRS Form W-9 will be sent to the Grand Prize Winner
via the email address provided to the Notification. If the Grand Prize
Winner fails to sign and return the Release and IRS Form W-9 within
the required time period, such Grand Prize Winner forfeits his/her
right to the Grand Prize and an alternate Grand Prize Winner will be
selected at random from among all remaining non-winning eligible
entries received. The value of the Grand Prize may be taxable as
income and Grand Prize Winner is solely responsible for any taxes on
the Grand Prize, including but not limited to all applicable federal,
state, provincial, and local taxes that become due with respect to the
value of the Grand Prize.
The Sponsor (or a party acting on its behalf) must report the value
of the Grand Prize to the IRS in the year the Grand Prize is
received by the Grand Prize Winner and will be reported to the Grand
Prize Winner and the IRS in the form of a Form 1099.
All applicable taxes on the Grand Prize are the sole responsibility of
the Grand Prize Winner.
GENERAL RULES OF PARTICIPATION:

LIABILITY RELEASE: By participating in this
Promotion, Entrants and Grand Prize Winner release each and all of
the Promotion Entities, from any and all liability, damages or
causes of action (however named or described) with respect to or
arising out of participation in the Promotion, and/or the receipt or
use/misuse of the prizes awarded, including, without limitation,
liability for personal injury, death or property damage.

FINALITY OF DECISIONS: By participating in this
Promotion, Entrants agree to be bound by these Official Rules and
the decisions of the Sponsor, which are final in all respects and
not subject to appeal. Sponsor reserves the right permanently to
disqualify from this Promotion any Entrant it believes has violated
these Official Rules.

PROMOTIONAL USAGE: Except where prohibited, winning
a prize constitutes permission for Sponsor and its agencies to use
Grand Prize Winners’ name, addresses (city &
state/province/territory), videos, photos, voices and/or likenesses
for purposes of advertising, promotion and publicity, for this
Promotion only, without further compensation, unless prohibited by
law.

LOST OR MISDIRECTED SUBMISSIONS: Sponsor and/or
Promotion Entities are not responsible for lost, late, misdirected,
undeliverable or incomplete entries, whether due to system errors or
failures, faulty transmissions or other telecommunications
malfunctions, entries not received resulting from any hardware or
software failures of any kind, lost or unavailable network
connections, failed, incomplete or garbled computer or telephone
transmissions, typographical or system errors and failures, faulty
transmissions, technical malfunctions, or otherwise.

CHEATING, HACKING, & DECEPTIVE SUBMISSIONS: Sponsor
may prohibit an Entrant from participating in the Promotion or
winning a prize if, in its sole discretion, it determines that said
Entrant is attempting to undermine the legitimate operation of the
Promotion by cheating, hacking, deception, or other unfair playing
practices or intending to annoy, abuse, threaten or harass any other
Entrant, Sponsor, or Promotion Entities.

UNFORSEEN TECHNICAL DIFFICULTIES: If for any reason
this Promotion is not able to be conducted as planned, including,
but not limited to, by reason of infection by computer virus, bugs,
tampering, unauthorized intervention, fraud or any other causes
beyond the reasonable control of Sponsor which corrupt or affect the
administration, security, fairness, integrity or proper conduct of
the Promotion, the Sponsor reserves the right at their sole
discretion to cancel, terminate, modify or suspend the Promotion and
select a Grand Prize Winner from those entries received up to the
cancellation/suspension date. Notification of such action will be
provided on the Website.

JURISDICTION: This Promotion is governed by the
laws of the United States without regard to conflict law provisions
or principles.

CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY
DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE
IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT
BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES
(INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST
EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE
TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A
WAIVER OF THESE PROVISIONS.
NO LIABILITY: By participating, Entrants agrees to
release, discharge, indemnify and hold harmless the Sponsor, Twitch,
Twitter and the Promotion Entities from and against any claims made by
Grand Prize Winner, Entrants, or any other third parties, related in
any way to the operation of this Promotion, as well as any other
claims, damages or liability due to any injuries, damages or losses to
any person (including death) or property of any kind resulting in
whole or in part, directly or indirectly, from acceptance, possession,
misuse or use of any prize or participation in any Promotion-related
activity or participation in this Promotion.
WINNER’S LIST/RULES REQUEST: For the name of the
Grand Prize Winners, please submit a self-addressed, stamped envelope
to be received by October 5, 2020 to “Intel Gamer Days - OMEN Giveaway experience” Promotion (please specify “Winner’s List”), PO Box 458, Newark, NY
14513. A copy of these Official Rules may be obtained on the Website
during the Promotion Period.
